By purchasing plans or services from JL Barndominium Artists, the customer (Licensee) agrees to this license agreement under a single-use license, which allows the Licensee to construct one building only. No additional use, reproduction, or distribution is allowed unless a multi-use license is purchased separately and in writing (1). JL Barndominium Artists does not supervise, manage, or oversee any construction processes and provides no warranties, expressed or implied, including but not limited to guarantees about the design documents, deliverables, or their suitability for any particular purpose or project (2). Purchasing, using, or modifying our plans means the Licensee agrees to a Hold Harmless Agreement, where they indemnify and hold JL Barndominium Artists harmless from any and all claims, losses, or liabilities, including those related to construction techniques, safety practices, design alterations, or any issues arising from how the plans are implemented or modified by builders, contractors, or other parties involved in the construction process (3). Liability for any claim or issue arising from the purchase or use of the plans is strictly limited to the original purchase price of the plans or services, and no additional claims for damages, losses, or other costs will be considered under any circumstances (4). JL Barndominium Artists is not, under any conditions, responsible for construction methods, safety standards, workmanship, or negligence caused by contractors, subcontractors, workers, or any parties responsible for implementing the plans or designs purchased (5). It is the Licensee’s sole and exclusive responsibility to verify compliance with all applicable local zoning codes, regulations, and building requirements, including obtaining necessary permits, conducting site evaluations, verifying material specifications, and ensuring all dimensions, measurements, and conditions on-site align with the requirements of the plans provided (6). The Licensee must ensure and independently obtain any additional engineering services necessary to meet specific site conditions, such as soil stability, wind loads, seismic activity, snow loads, or other environmental or structural considerations that may impact the design, construction, or long-term stability of the project (7). In certain jurisdictions, the plans may require a professional stamp from a state-licensed Architect or Structural Engineer, and obtaining these stamps or approvals is solely the Licensee’s responsibility and expense, as JL Barndominium Artists does not provide stamped plans (8). Due to U.S. copyright laws, specifically under 17 U.S. Code 102(8), and to prevent unauthorized reproduction of the plans, no refunds, returns, or credits will be issued for ready-made plans, modifications, or custom design services once the order has been processed and delivered, including any purchases involving full or partial modifications paid for online; therefore, all sales are final (9). All plans, content, and related materials are protected under U.S. copyright laws and may not be copied, resold, reproduced, or distributed in any form without obtaining written permission from JL Barndominium Artists (10). JL Barndominium Artists retains all ownership rights, copyrights, and intellectual property rights to all custom and modified plans created, delivered, or sold through our services (11). Plans provided to the Licensee may include digital watermarks or other methods of identification to prevent copyright infringement and unauthorized distribution (12). Payment for all plans, modifications, and design services is due immediately upon purchase, and for example, when purchasing stock plans through our ecommerce platform, full payment is required before plans are delivered, with no exceptions (13). For invoiced services, including but not limited to plan modifications, redesigns, or custom house plans, full payment is required before our team begins any work on the requested project (14). We accept all major credit cards, and payments made through our ecommerce website are securely processed using Stripe; no other payment methods, such as wire transfers or checks, will be accepted (15). The plans are designed in compliance with generally accepted zoning principles, which may or may not align with the local zoning laws, regulations, or restrictions in the Licensee’s intended building location, and verifying such compliance is solely the Licensee’s responsibility (16). While our plans are designed to meet most national building codes at the time they were created, many states, counties, and municipalities modify or amend these codes; therefore, it is the purchaser’s or builder’s responsibility to ensure the structure complies with all local, state, and federal building requirements (17). By purchasing and using the plans, the customer indemnifies and holds JL Barndominium Artists LLC, including its owners, employees, and agents, harmless from any claims, losses, or liabilities resulting from the failure of the plans to comply with zoning laws, building regulations, or any other breaches of this agreement attributable to the Licensee, their builder, or other parties involved (18). Some municipalities require plan reviews or additional certifications by licensed professionals in the area where the project is being built; the Licensee is responsible for obtaining these approvals and covering any additional expenses incurred to meet local municipality requirements (19). When purchasing plans, the Licensee is purchasing a license to build, not the copyright to the house plans; this license grants the Licensee the right to construct one structure using these plans unless a multi-use license has been purchased separately (20). Any attempt to build the house multiple times, modify, or copy the plans without written permission constitutes a violation of copyright laws, and if the option for a multi-use license is not listed, the Licensee must contact JL Barndominium Artists to inquire about additional fees for such rights (21). The plans, information, and specifications provided are delivered “as is” without any warranties, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of rights (22). JL Barndominium Artists assumes no responsibility for typographical errors, technical inaccuracies, or omissions in the documents, plans, or references, and we reserve the right to make changes or updates at any time without prior notice to the Licensee (23). All renderings, floor plans, and content displayed on our website or in other media are the property of JL Barndominium Artists; we are not responsible for interpretation of the plans or for the structural integrity of buildings constructed using these plans (24). The Licensee is responsible for ensuring that the building complies with all local codes, regulations, and requirements, and must obtain any necessary structural analysis, engineering, and site-specific specifications before beginning construction (25). For custom design services, the prices included in our packages apply to projects under 5,000 square feet. If a project exceeds 5,000 square feet, additional costs will apply at a rate of $0.50 per extra square foot. Our pricing covers the design of the main house and garage only. If a project includes additional buildings—such as a guest house, shop, small house, or any other separate structure—these will be considered separate projects and priced at 50% of the selected package price. For example, if the main house package is priced at $1,500, a guest house would cost $750. (26). We offer unlimited revisions as part of our packages; however, this does not extend indefinitely. After final blueprints are sent to the client, unlimited revisions remain available for 30 days. If no revisions are requested during this 30-day window, we will assume the client is satisfied, and the project will be marked as completed. Any requests for revisions after this point, whether 2 months, 1 year, or longer, will incur an additional fee of $420 (27). The license granted to the Licensee is non-transferable. The Licensee may not assign, sell, sublicense, or transfer the plans, designs, or services to any third party without prior written consent from JL Barndominium Artists (28). The plans, designs, or deliverables may not be used for any purpose other than the construction of the intended single structure. They may not be used as a base or reference for creating derivative works, new designs, or plans unless prior written permission is obtained (29). JL Barndominium Artists actively monitors for copyright infringement. Any unauthorized use, reproduction, or distribution of our plans will be pursued to the fullest extent of the law, including seeking damages and legal fees (30). JL Barndominium Artists shall not be held liable for delays, disruptions, or inability to deliver services due to unforeseen circumstances beyond its control, including but not limited to natural disasters, acts of war, labor strikes, or technological failures (31). Once the payment has been processed, no refunds can be issued under any circumstances due to the complexity of our system and workflow. Our processes involve immediate allocation of resources, design work, and system integration, making it impossible to reverse or undo transactions once initiated. By proceeding with the purchase, the Licensee acknowledges and agrees to this no-refund policy (32). By purchasing our plans, the Licensee acknowledges they have reviewed examples of blueprints provided by JL Barndominium Artists and verified with their local department or contractor that the level of detail meets the requirements for their state or local jurisdiction (33). Unlimited revision add-ons are designed to ensure you are completely satisfied with the final design. However, to keep the process efficient and timely, these add-ons will expire if we do not receive feedback from you within 30 days after sending the updated design. This means that if you do not respond or provide your input within this time frame, the unlimited revision option will no longer apply to your project. We encourage you to review the design and share your thoughts as soon as possible to ensure we can make any necessary adjustments promptly (34). I have carefully reviewed the design examples displayed on your website and fully understand the level of detail and quality provided in these plans and designs. I confirm that the details shown meet my expectations and requirements. I acknowledge that these examples reflect the standard of work I will receive, and I agree that this level of detail is satisfactory for my needs (35). After final blueprints are delivered, major changes such as redesigning the entire floor plan will not be accommodated. However, minor adjustments and refinements can still be requested within the 30-day revision period at no additional cost. Any requests beyond this scope may require additional fees(36). At JL Barndominium Artists, we specialize in providing high-quality design services for barndominiums and custom homes. While our designs are created with attention to detail and industry standards, building codes and regulations vary by state and locality. It is the client’s responsibility to ensure that all designs meet local building codes, zoning regulations, and permit requirements. We strongly recommend consulting with a licensed local engineer to review and verify the plans before proceeding with construction. JL Barndominium Artists is not liable for any structural, engineering, or construction-related issues that may arise. Our scope of work is limited to design services only, and we do not provide engineering or construction services. By using our services, you acknowledge and accept this disclaimer(37).
